The Directorate General of Taxes (DGT) of Costa Rica informs that a period of ten working days has been granted to bodies representing various interests to submit their objections. These objections are based on Article 174 of the Code of Tax Rules and Procedures. Therefore, these qualified organisations will be able to submit these details on the draft resolution in Costa Rica that refers to the transfer pricing information return.    

What does this project consist of? 

The Draft Resolution aims to establish clear guidelines and enhanced oversight of transfer pricing in Costa Rica. Specifically, it focuses on defining the process for the annual filing and determining which taxpayers will be subject to this requirement. 

The affected taxpayers include: 

  • Large national taxpayers and entities located in free trade zones. 
  • Taxpayers whose transactions exceed 1,000 base salaries (approximately €758,000). 

The declaration must be filed through the TRIBU-CR virtual platform. Since the Resolution will apply to the 2024 fiscal year, the filing obligation will take effect once the Resolution comes into force. Additionally, the DGT of Costa Rica specifies in the official document the codes corresponding to each economic activity related to transfer pricing. 

When and how to submit comments?  

The public consultation period started on February 17 and will remain open until Friday, February 28. During this time, organizations interested in providing feedback must send their observations in writing to the designated email address: FiscaTecnicoJuridico @ hacienda.go.cr.
