In Spain, a ministerial order came into effect on October 29th, establishing the technical, functional, and content aspects that billing process computer systems must adopt, as well as the standardization of payment record formats used by businesses and professionals.

The development of the Veri*factu Regulation aims to ensure the integrity, preservation, accessibility, readability, traceability, and immutability of these records. All of this is to combat tax fraud, in line with Royal Decree 1007/2023.

This regulation mainly applies to Corporate Income Tax and Non-Resident Income Tax payers with a permanent establishment, as well as to Personal Income Tax payers and entities that attribute income and engage in economic activities (provided they do not keep VAT records through the tax administration’s electronic headquarters via the Immediate Supply of Information (SII)).

There are two ways to comply with this regulation:

  1. Use certified billing software, or alternatively, the software developed by the Tax Administration (within its limitations).
  2. Employ a system for sending verifiable invoices, whereby all billing records are sent voluntarily and automatically via electronic means.

In principle, taxpayers must have their systems adapted by July 1, 2025, while manufacturers and marketers have this obligation starting July 29, 2025. Given the inconsistency of dates and the prospect of receiving numerous technical inquiries, a delay in the implementation of the regulation until 2026 has been proposed. If postponed, the dates would be as follows: January 1, 2026, for Corporate Income Tax payers and July 1 for the rest.
