Belgium will apply on 2025 respective news according to VAT return, especially for those focused in quarterly VAT return, non-paid sanctions and a new way of refund of VAT credit. All these measures, established on 12th March 2023 Law, were supposed to be applied this year, but, finally, were delayed. 

With respect to VAT returns, those taxpayers who are subject to quarterly declarations will benefit from a longer delay submitting, having to the day 25th of each next month after ending the correspondent quarter. Monthly taxpayers must continue as well as nowadays, paying until the 20th day.  

Another important change will be the issuance of VAT assessments by the Tax Office in those cases where taxpayers have failed to submit the VAT declaration on due time. This substitute VAT return will be sent three months after the end of the reporting period and the calculation of the payable amount will be based on the highest amount of VAT due declared during the previous twelve months, besides the applicable fines and/or interests. Therefore, taxpayers will have a delay of one month to contest this VAT assessment, after which it will become definitive. 

Lastly, there will be a few changes regarding the refund of VAT credit generated in the periodic tax returns. From 2025, taxpayers will be allowed to claim a monthly refund of VAT credit, without a prior authorization, which is currently required until the end of fiscal year 2024. Nevertheless, it will be possible to claim only the amount of VAT credit generated in the period being declared. As for the amount of VAT credit accumulated in previous periods and which has not been claimed in the corresponding declarations, taxpayers will be able to monitor it through their MyMinfin online account, and decide if they want to ask for a refund of part or the total of the accumulated amount, or use it to compensate the payment of other tax obligations.
