To bring in 2022, the Portuguese Government has issued a series of legislative changes related to labor management. Let’s take a look at the most relevant.
Extensions of the period of justified absence by death of 1st degree descendant
Law no. 1/2022 of 3 January 2022 changes Portuguese Employment Law to extend the period of justified absence in the event of the death of a 1st degree descendant or similar (in a straight line), to 20 days.
The bereavement period due to the death of an ascendant in the 1st degree (in a straight line) will continue to be five consecutive days.
Both parents will also be entitled to request psychological follow-up from an attending physician in the National Health Service (SNS – Serviço Nacional de Saúde), which must start within five days of the death of the dependent. This right is also guaranteed in the event of the death of close family members, namely spouse and ascendants.
This law enters into force on the day following its publication, namely 4 January 2022.
Changes on the Social Security index
From 1 January 2022, under Ordinance no. 294/2021 from 13 December, IAS (IAS – indexante dos apoios sociais) increases from the current €438.81 to €443.20.
The Portuguese Social Security index is a reference for Social Security benefits, such as unemployment, sickness, and child benefits. The IAS value is also the base for calculating the minimum social security contributions due from board members who are not enrolled in a mandatory social security scheme.
